Best Practices Guidelines for Real Estate During COVID-19

 

  • CAR requires that the new Form PRE (Posted Rules for Entry) must be posted at the entrance to the property and clearly visible. In addition have a link to or publish these rules in MLS listings and publicly online in order to comply with new statewide agent display requirements.

  • The buyer, agents and all visitors entering the property must sign the Form PEAD-V (Coronavirus Property Entry Advisory and Declaration - Visitor) and deliver it electronically to the listing agent in advance.

  • Only ONE agent may show a property to a maximum of TWO people from the same household.

  • Listing Agreement Coronavirus Addendum or Amendment (RLA-CAA) must be signed by sellers and listing agents.

  • The property must be equipped with hand sanitizer, sanitizing wipes and face masks. Listing agent/brokerage is ultimately responsible for ensuring that these items are supplied.

For the purposes of this Order, Essential Businesses are:

Service providers that enable real estate transactions (including rentals, leases, and home sales), including, but not limited to, real estate agents, escrow agents, notaries, and title companies, provided that appointments and other residential real estate viewings must only occur virtually or, if a virtual viewing is not feasible, by appointment with no more than two visitors at a time residing within the same household or living unit and one individual showing the unit (except that in-person visits are not allowed when the occupant is present in the residence).

Updates to the County Order

The following changes are effective, Wednesday, March 24:

  • All activities authorized under the State’s Orange Tier, including indoor dining, can resume in accordance with State capacity limits and safety protocols, including:

    • Indoor dining at maximum 50% capacity or 200 people, whichever is fewer;

    • Retail stores indoors with modifications;

    • Gyms and fitness centers indoors at maximum 25% capacity, with indoor pools open

    • Movie theaters at maximum 50% capacity or 200 people, whichever is fewer

    • Family entertainment centers indoors at maximum 25% capacity with modifications for areas of increased risk of proximity; and

    • Zoos, museums, and aquariums at 50% maximum indoor capacity.

On December 3, 2020, the State issued a new Regional Stay at Home Order that defines new additions to the prior order’s directive by imposing tighter restrictions on any Region in which ICU capacity drops below 15%.

In Santa Clara County, the new Mandatory Directive for Implementing State’s Regional Stay at Home Order will remain in effect until January 4, 2021 at 12:01 a.m. unless the County Health Officer modifies or extends it.

According to the Health Officer’s New Regional Stay at Home Order issued on December 3, 2020 members must continue to maintain strict safety and social distancing protocols:

  • Open houses and tours are still prohibited.

  • Virtual showings are preferred. However, if virtual showings are not feasible, occupied properties may be shown under the following conditions.

  • All previously ordered social distancing and sanitizing protocols apply.

  • Occupants must leave a property within a reasonable time prior to and following a showing.

  • All residential moves will be allowed to proceed.

  • Commercial real estate is now classified as an “essential service”.

  • All construction projects can resume, provided they comply with the Construction Project Safety Protocols issued as part of the Order.

  • Inspectors and appraisers are permitted to enable residential real estate transactions to occur. 

  • Real estate photographers are permitted to enable virtual viewings and marketing to occur. 

  • Stagers are permitted one at a time, alone, and at a time when the resident is not at home

  • Before conducting any business transactions first consult with your broker and adhere to specific rules and guidelines established by your respective corporations/firms and the requirements set out in County/City orders. Members should seek individual counsel for legal and insurance matters.
